Hoy quiero hablar de uno de esos casos bonitos en los que más que dinero de por medio lo que está en juego es la personalidad del autor y el respeto a su obra. Los derechos morales son un fenómeno típico de la Europa continental con una tradición espiritualista de los derechos de propiedad intelectual en los que el autor es la piedra angular de la creación y por lo tanto merecedor de una protección que va más allá de sus intereses económicos abarcando además a las obras como plasmación física de su propia personalidad. Aunque los países anglosajones han tenido siempre una visión muy patrimonialista de los derechos de propiedad intelectual su incorporación al Convenio de Berna obligó la adaptación de su sistema al respeto de los derechos morales de los autores aunque esta protección ha sido mayor o menor dependiendo del país (en EE. UU por ejemplo sólo tienen derechos morales los autores plásticos). Sehgal recibió en 1959 el encargo de crear un gran mural para el edificio del ministerio obra que se finalizó en 1962 y que contaba con más de 12 metros de altura y 42 metros de largo. El mural fue un tremendo éxito ya que conseguía proyectar “la verdadera India” su pueblo gentes y costumbre en toneladas de bronce macizo. Pero un buen día se decidió restaurar por completo el edificio desmontando temporalmente el mural… hasta la actualidad. Y el caso llegó finalmente al Tribunal Supremo de la India donde Sehgal tuvo la suerte de encontrarse con un juez amante del arte que defendió en todo momento al autor y a la “Justicia Poética”: “En el año 1962 los yermos muros de Vigyan Bhawan recibieron la bendición de un mural…creado por las mágicas manos del escultor Amar Nath Sehgal y aclamado por todos los que saben apreciar la belleza … No dejó nunca de cautivarnos … Sin ban en 1979 fue arrancado y quedó relegado en un almacén. As for AOL News. I think it is a study step forward.
